Cases challenging the forced & coerced sterilization of Women Living with HIV to be heard in October 2017

The High Court has set the hearing dates of the cases challenging the forced and coerced tubal ligation of women living with HIV. Justice Mwita has directed that Petition No. 605 of 2014 be heard on 4 October 2017 while Petition No. 606 of 2017 will be heard on 9 October 2017.

The Petitions were scheduled for hearing on 26 and 27 June 2017 but they did not proceed because the judge was unavailable on that day.

Allan Maleche, advocate for the Petitioners and KELIN Executive Director, said

“given that it has been over two years since we filed the case, and we have been unable to proceed two times the cases had been scheduled for hearing, I am hopeful that this time we shall be able to proceed with the hearing.”

The petitions were filed on 10 December 2014 to challenge the unconstitutional sterilization by way of tubal ligation of the five women living with HIV. Similar cases have been reported in Namibia, Lesotho, Swaziland, South Africa and Uganda.
