International Community of Women Living with HIV applies to be enjoined onto Petition 605 of 2014

Nairobi, July 30: The International Community of Women Living with HIV (ICW), through their lawyer, have filed an application seeking to be enjoined onto the case as an interested party. If enjoined ICW will provide information on experiences of women living with HIV around the world as it relates to stigma, discrimination and abuses stemming from tubal ligation. They will however have to wait till the 2 November 2015 before their application is argued.
The court, during the mention of the case, allowed an application by Mr. Maleche, Advocate for the Petitioners, seeking to amend the Petition. The court directed Mr. Maleche to file the amended petition within 14 days. An application by UNAIDS seeking to be enjoined onto the case as a friend of the court will also be heard on 2 November, 2015. This has been occasioned by the fact that, MSF- France through their lawyers, have opposed the application on grounds that UNAIDS has not shown that the submissions it intends to advance in court will give any assistance to the court neither will the submissions introduce new arguments different from those already advanced by the parties.
The matter comes up on 2 November, 2015 at 9:00 am when the applications by UNAIDS and ICW to be joined onto the cases will be heard.
