Access to safe and affordable medicines is critical to the enjoyment of the highest attainable standard of health as guaranteed in the Constitution of Kenya 2010. Access to medicines entails having safe medicines; continuously available and affordable at both public and private health facilities including medicine outlets. Indeed, antiretroviral medicines have greatly improved the lives of people living with HIV. However, access to affordable antiretroviral medicines continues to be impacted negatively by intellectual property barriers, specifically patents.

Under the project titled “Challenging intellectual property barriers that prevent access to treatment for people living with HIV in Kenya”, KELIN intends to increase access to affordable treatment for people living with HIV by addressing intellectual property barriers at the national and regional level and holding the government accountable for access to essential medicines.

In 2020, the Kenyan government commenced the process of reviewing the intellectual property legal regime. An Intellectual Property Bill 2020 was published and circulated for public review. KELIN, with support from Aidsfonds undertook an analysis of the Bill 2020 and developed a policy brief summarizing the relevant parts of the Bill, identifying gaps, and providing recommendations.
