Description
This is a petition against the Cabinet Secretary Ministry of Health, the County Government of Kakamega, and Emusanda Health Centre, challenging the administration of contraceptives to the petitioners, who are minors, allegedly without informing or obtaining the consent of their parents. The petitioners claim that the respondents’ failure to obtain the consent of the petitioners’ parents, thereby sidestepping their parents’ role in decisions concerning their welfare and safety, violated the petitioners’ rights under Articles 22, 26, 28, 35, 43(1), and 53 of the Constitution of Kenya, 2010. The petitioners therefore pray for various orders, including a blanket ban prohibiting healthcare professionals from providing sexual and reproductive health services or information to adolescents without parental or third party consent.
