Advancing Legislation: The Public Participation Bill and the Constitution of Kenya   Amendment Bill,2024

KELIN, alongside other members of the Civil Society Parliamentary Engagement Network, participated in the submission of a memoranda:

  1. To the Senate, opposing the Constitution of Kenya Amendment Bill, 2024
  2. To the Office of the Attorney General and Department of Justice, making a case for the amendment and deletion of certain clauses and to propose the addition of more clauses.

The Constitution of Kenya,2010 is a fourteen-year-old law which creates a conducive environment for the enjoyment of health-related rights by addressing aspects of governance, legislative and fiscal transparency. Preserving the letter and the spirit of the Constitution is therefore paramount in protecting an integral part of Kenya’s democratic state.

Participation of the people is a national value that allows the citizens of Kenya to contribute to their governance and exercise their sovereignty as the ultimate holders of power which they have delegated to their elected representatives. A legislative framework that facilitates the exercise of this practice ought to provide the responsible authority with guiding principles for application.
