The High Court has directed that a case challenging the forced and coerced tubal ligation of women living with HIV (Petition 605 of 2014) be heard on 27 and 30 April 2018.
Justice E.C Muita adjourned the case upon an application made by the advocate representing Marie Stopes International who was not ready to proceed with the hearing. The advocate in requesting for an adjournment informed the court that he had been held up in an election petition in the High Court at Embu and had not had time to prepare for the hearing given that the election petition is still ongoing.
GWK one of the petitioners is quoted as saying; “we were ready to proceed, unfortunately, one of the lawyer was not ready. We shall continue to press on until we are heard and justice is delivered.”
The petition was filed on 10 December 2014 to challenge the unconstitutional sterilization by way of tubal ligation of the four women living with HIV. Similar cases have been reported in Namibia, Lesotho, Swaziland, South Africa and Uganda.
