Case on Forced and Coerced Sterilization of Women Living with HIV not heard due to Heavy Court Schedule

The parties involved in Petition 605 of 2014, the case challenging the challenges the forced and coerced sterilization of four women living with HIV, attended court on 19th October 2021 to highlight their respective submissions. Despite the fact that all of the parties had prepared and were willing to proceed, the matter could not be heard due to the heavy court schedule.

The court had several matters and while we were listed as the first hearing, the court was able to call out our matter at noon and allocate time for hearing at 3pm and the court was only able to complete its cause list at 3:40pm. In the circumstances the court directed that the matter be adjourned to 4th November 2021 at 1pm when the court would set aside the entire afternoon for the case. The court took into account that the matter is old, and the documents are bulky.

The petition has been court for seven years and the petitioners welcome the date set by the court for the highlighting of submissions with the hope that the matter will soon be concluded, and that justice is served.

PLEASE NOTE: The petitioners request that their names and identity should not be disclosed in the media to protect them from further stigma and discrimination on the basis of their HIV status. They are therefore not available to give interviews.
