On 18 January 2018, the High Court in Nairobi directed the case challenging the forced and coerced sterilisation of women living with HIV to continue on 19 March 2019. This was during the hearing of the respondents’ case when four witnesses for Medicines Sans Frontiers – France (MSF) testified.
The four witnesses told the court that MSF was providing milk formula and food portions to mothers who had been admitted at the prevention of mother to child transmission (PMTC) department. The witnesses explained to the court that MSF would refer patients to Pumwani Hospital for delivery in accordance with a memorandum of understanding that existed between the two facilities. They also confirmed that before 2007, MSF was not providing family planning services but had a referral mechanism that it would use to refer patients to other facilities. One such facility was Marie Stopes and Huruma Lions Clinic.
The court will proceed to hear the testimony of the Marie Stopes witness on 19 March 2019.
