The High Court of Kenya has set down the 18th September 2023 as the date for delivery of judgment in the case seeking to hold the state accountable for the provision of information for the protection of health and life during the Covid-19 pandemic.
On 2nd July 2020, 13 Petitioners filed an urgent case against various government agents in the High Court for failure to proactively provide information and respond to requests to information to secure the health and lives of Kenyans and in violation of Article 35 of the Constitution of Kenya, 2010 and the Access to Information Act, 2016.
KELIN together with other civil society and non-governmental organisations, which include Katiba Institute, International Commission on Jurists (ICJ), Transparency International Kenya and Ms. Achieng Orero (on behalf of Women’s Link Worldwide) together with eight other individual petitioners sought to hold accountable, government officials responsible for the pandemic response, for denying citizens requisite information required to fulfil their right to the highest standard of health.
Final arguments in the matter were heard on 24th October 2022. We look forward to the judgment which shall be delivered on 18th September 2023 and to the vindication of the rights of the people of Kenya, in the hope that the court shall give a judgment that sets a precedent for the delivery of life saving information during times of public health crises.
