High Court Sets Hearing Date for a Landmark case challenging forced and coerced sterilization of WLHIV

Constitutional and Human Rights Division Judge, Justice Isaac Lenaola, has directed that a case challenging the forced and coerced sterilization of women living with HIV be heard on 2 December, 2016. The Judge issued this order following the mention of Petition 605 of 2014 on 7 October 2016. All parties are therefore expected to file their responses to the amended petition and written submissions with the court before the hearing date.

The court further directed that it will commence the hearing on 2nd December with the testimony of two out of the four petitioners and will rely on their oral testimony as well as their sworn affidavits.

The petition challenges the unconstitutional forced and coerced sterilization of four women living with HIV and is against Médecins Sans Frontières – France (MSF- France), Pumwani Maternity Hospital, Marie Stopes International, the Nairobi County Executive Committee Member in Charge of Health Services, Cabinet Secretary Ministry of Health, and the Attorney General. Also enjoined to the case are UNAIDS Secretariat, ICW-Kenya, ICW-Global, National Gender and Equality Commission and Prof Alicia Yamin.
