The workshop participants will discuss the link between HIV, Law and Human Rights. They will also interrogate topics that include: HIV as a human rights issue; the legal and ethical issues arising out of HIV; strategic litigation on the right to health; and criminalization of HIV, among others.
The workshop aims at building the capacity of lawyers to handle cases related to HIV and the right to health. This is based on the fact that lawyers play a crucial role, through litigation, legal advisory services, and criminal prosecution, in enhancing the realization of rights of the general public. This is a build-up from previous workshops that were conducted with lawyers in the counties of Mombasa, Kilifi, Nakuru, Kisumu, Kakamega and Bungoma. One of the key recommendations of the Global Commission report on Law and HIV called upon groups outside government to develop and implement rights-based HIV-related policies and practices and fund action on HIV-related law reform, law enforcement and access to justice. This workshop seeks to actualize this recommendation.
