The Global Commission on HIV and the law, in its July 2012 report Risks, Rights & Health identifies that,
“the law alone cannot stop AIDS. Nor can the law alone be blamed when HIV responses are inadequate. Nonetheless, the legal environment can play a powerful role in the wellbeing of people living with HIV and those vulnerable to HIV. Good laws, fully resourced and vigorously enforced, can widen access to prevention and health care services, improve the quality of treatment, enhance social support for people affected by the epidemic, and protect human rights that are vital to survival and save the public money. The report also demonstrates that the law if well enforced has the ability to reduce the number of new infections by 1 million.”
The HIV & AIDS Tribunal was established by the HIV & AIDS Prevention and Control Act 2006. The Tribunal formally began its operations in 2011 with the swearing in of its first chairperson Mr. Ambrose Rachier. In 2015, KELIN with support from UNDP-Kenya initiated development of HAT compendium of cases to document cases that have been decided by the Tribunal since its inception. The publication of the collection of cases seeks among other objectives, to raise awareness of the public on the consequences of violating the rights of persons living with or affected by HIV, so that they can take reasonable precautions to avoid such violations.
