Media Advisory: Hearing of Applications for the Upcoming Forced & Coerced Sterilization Cases Petition 606 of 2014

What: Hearing of three applications in Nairobi High Court Petition No. 606 of 2014 by:
(i) Marura Maternity and Nursing Home seeking to enjoin Price Waterhouse Coopers (PWC) and OBA RH as an interested party,
(ii) The Secretariat of the Joint United Nations Programme on HIV/AIDS (UNAIDS) seeking to be joined as friend of the court.
(iii) Kenya Legal & Ethical Issues Network on HIV & AIDS (KELIN) seeking to amend the petition.

 

Who: LAW (The 1st Petitioner), KELIN, African Gender and Media Initiative Trust (GEM) Vs Marura Maternity and Nursing Home, the Nairobi County Executive Committee Member in charge of Health Services, the Cabinet Secretary – Ministry of Health, Republic of Kenya.
Why: Marura Maternity and Nursing Home has applied to have PWC and OBA-RH enjoined onto the case because they argue that Marura was only an independent contractor and that they were approached by the 1st petitioner based on the advice and assessment she had received from PWC and OBA-RH. The application by Mr. Maleche to amend the petition seeks to introduce new prayers, introduce new facts and developments in law on the area. The application by the UNAIDS Secretariat seeks to have them joined as a friend of the court to respectfully ensure that the court is fully appraised of the international perspectives relating to the issues of forced and coerced sterilization.
