Press Conference on Gross Irregularities in the Public Procurement Oversight Authority Market Price Index

The Kenya Legal and Ethical Issues Network on HIV and AIDS (KELIN), the Society for International Development (SID) and Transparency International-Kenya (TIKenya) wishes to invite the media to a press conference on Sunday, 24th April 2016, 10.00am at Society for International Development Boardroom. The press conference will launch a policy brief that demonstrates how the Public Procurement Oversight Authority has violated the law and maintained a Market Prices Index with highly inflated pricing standards for medical equipment and essential medicines.

On the eve of the World Malaria Day 2016, the Society for International Development (SID), Transparency International-Kenya (TI-Kenya) and the Kenya Legal and Ethical Issues Network on HIV and AIDs (KELIN) will reveal that the Market Prices Index of the Public Procurement Oversight Authority (PPOA) is currently sanctioning procurement inefficiencies at national and county levels.

The Market Price Index (MPI) is the Government main standard for pricing standards for all goods and services. Based on investigative research, the MPI is not informed by fair market prices. The MPI price standards are considerably higher than the price standards offered by Kenya Medical Supplies Agency (KEMSA), Mission for Essential Drugs and Supplies (MEDS) and the Management Sciences for Health (MSH).

The Market Prices Index legally permits procurement officers and other public officials to procure goods above competitive and cost-effective prices contrary to the Public Procurement and Asset Disposal Act (2015). In its current form, it also disregards the November 23rd Presidential Directive and National Call to Action Against Corruption in at least two respects.

The launch of the Policy Brief will demonstrate the extent of irregularities in Market Prices Index and the impact it has on the procurement of medical goods and services. The findings have a huge implication for all public procurement across National and County Governments.
