The KELIN Cultural Structures Project in HomaBay and Kisumu Counties, which works to settle disputes between widows and their in laws in a manner that respects human rights, has been running since 2009. In an effort to upscale this, KELIN will conduct a five-day workshop for elders and widows drawn from Kisumu and Homabay counties from 16 to 20 June 2014 in Kisumu County. The participants are part of the stakeholders who KELIN has been working with to assist widows and orphans who have been disinherited and left homeless to reclaim their rights to inherit and own property.
The training is aimed at strengthening their capacities on land and property rights, the mediation process and documentation of cases. The documentation will serve as a precedent for elders in mediating future cases, as reference material for those who will engage in similar mechanisms and at the same time serve as a good practice guidance to offer to the judicial system in actualizing Article 159 (2) (c) of the Constitution.
Some of the topics to be discussed at the forum include:
• Constitutional provisions with regard to land and property rights;
• Gains made by women on land and property rights in the Land Act and the Land Registration Act;
• Attitudes, social and cultural norms that affect women’s land and property rights;
• Advantages of mediation in protecting women’s land and property rights; and
• Documentation of cases during and after the mediation process.
At the end of the training it is expected that the participants, especially the elders, will be able to properly document cases they are mediating upon to ensure a record for future reference.
