Nairobi, July 29: Constitutional and Human Rights Division Judge Justice Mumbi Ngugi allowed an application by UNAIDS seeking to be enjoined as a friend of the court. The court equally allowed an application by the International Community of Women Living HIV (ICW) seeking to be enjoined as an interested party. This was during the mention of a case, which was filed on 10 December, 2014 challenging the unconstitutional sterilization by way of tubal ligation of L.A.W a woman living with HIV.
An application by Allan Maleche on behalf of the Petitioners seeking to amend the Petition was allowed and he was given 14 days within which to file and serve the amended Petition. The court allowed the three applications after the lawyers for the different parties in the case indicated to court that they did not have any opposition to any of the applications.
The application made by Marura Maternity and Nursing Home, seeking to enjoin Price Water House Coopers and OBA-RH as interested parties will be heard on 2 November, 2015, given that PWC have opposed the application.
The matter comes up on 2 November, 2015 at 9:00 am when the application made by the Marura Maternity and Nursing Home will be heard.
